1. ENROLLMENT CHANGES, CANCELLATIONS & RESCHEDULING:
Due to the nature of this program, refunds for cancellations within 48 hours prior to a camp will not be allowed. Refunds or credits will also not be given if a rider is unable to complete the entire camp or program. Rider must pay a $275 deposit and the remaining balance on the first day of camp (Jan 6th). If the rider cancels enrollment after January 1st, the deposit in non-refundable.
2. SAFETY
454Factory has made all efforts to ensure Rider’s safety during any and all training sessions under this Agreement. As with any training session, Rider will be involved in dangerous activities during this program. Rider agrees that it has no disabilities or physical conditions that would limit Rider to participate in this program. Rider agrees to assume full responsibility for these risks and agree to release 454Factory, for any liability.
3. PROMOTIONAL RIGHTS
As part of this Agreement, and for no additional consideration or agreement, Rider/Guardian hereby consents to 454Factory use of rider’s name, image and likeness for promotional or commercial purposes, including photographs and video tapes arising out of rider’s participation in the program. Client hereby assigns all rights, title and interest client may have in or to any and all media in which rider’s name or likeness might be used by 454Factory. Rider agrees not to make any claim of a violation of rider’s rights of publicity or privacy as a result of 454Factory exercise of its rights hereunder.
4. ACKNOWLEDGEMENT OF RISKS
Rider understands that this program involves highly strenuous and dangerous athletic and physical fitness activities and recognizes that participation in such strenuous and dangerous activities inherently involve health and injury risks, which can be very serious, to include death. Rider understands and knowingly accepts these risks.
5. RELEASE
By signing this agreement, Rider hereby irrevocably and unconditionally fully releases and forever discharges 454Factory from any and all claims, actions or other proceedings of every kind and nature for any loss, injury, illness, death, damage and/or liability whatsoever of every nature and kind, in law or in equity, whether now known, anticipated or otherwise, which any Rider had, has or may have against 454Factory, directly or indirectly, arising out of, resulting from, or in any way associated with any personal training or fitness activity.
6. INDEMNIFICATION
In consideration of 454Factory’s acceptance of rider’s request to participate in the services, Rider hereby indemnifies, releases and forever discharges 454Factory and any representatives from any liability, claims, losses, costs, or expenses, and waives the right to pursue legal action against 454Factory arising directly or indirectly from Rider’s participation in the services, including claims or damages resulting from death, personal injury, partial or permanent disability or property damage, medical or economic losses, including attorney’s fees, whether caused in whole or in part from the services or any instruction or training associated with the services and whether based upon the breach of any express or implied warranty, negligence or under any other legal theory. This release shall be binding upon Rider’s heirs, assignees, successors and personal representative.
7. COMPLIANCE WITH LAWS
454Factory, in the performance of this Agreement, shall comply with all applicable federal, state or local laws and ordinances, including regulations for licensing, certification and operation of facilities, programs and accreditation, and licensing of individuals etc.

8. PAYMENT
Payments must be made in full by cash, credit or check. Participants must pay on the first day of training in the balance of $1000 (If participant has put in a deposit). A deposit is required to fill a spot into the program. If a rider chooses to cancel enrollment into the program it must be done by January 3rd to receive a full refund. If the rider has not put in a deposit for the program the balance is $1150.

9. THE FOLLOWING RULES MUST BE READ BY PARENTS AND RIDERS
1. Student should arrive on time to begin coaching on time. Students should participate until the end of
coaching and dismissal.
2. Students are to arrive to training AND races prepared. Race bikes are to come prepared. Bikes needing mechanic work upon arrival cannot be serviced before bikes that are damaged in, or at the event.
3. During coaching, training, and private sessions. Parents agree not to interfere between trainer and student during lessons. For the best racer development the trainer will need the student’s full, undivided attention.
4. Students must behave appropriately and respect teachers, coaching instructors, management members, employees and fellow students. If any student exhibits disruptive behavior which is distracting to the coaching, including verbal harassment or vandalism, the student will be dismissed from class without refund. Physical aggression by any student will result in automatic expulsion.

10. ENTIRE AGREEMENT
The parties agree that this Agreement is the complete expression of the terms hereto and any oral representations or understandings not incorporated herein are excluded. Further, any modification of this Agreement shall be in writing and signed by both parties. Failure to comply with any of the provisions stated herein shall constitute material breach of contract and cause for termination. Both parties recognize time is of the essence in the performance of the provisions of this Agreement.
